ConnectAble Terms of Service
Effective Date: September 1, 2026
These Terms of Service govern access to and use of ConnectAble’s public websites, school platforms, student dashboards, software, communications tools, support resources, and related services. They apply to participating adult education schools and programs, their staff and contractors, students, and other authorized users. A school membership agreement, order form, data protection agreement, or other written agreement may add to or replace parts of these Terms.
Please read these Terms carefully. By accessing or using the Services, you agree to them. If you use the Services for a school, adult education program, nonprofit, government agency, or other organization, you also confirm that you have authority to accept these Terms for that organization.
1 Definitions
“ConnectAble,” “we,” “us,” and “our” mean ConnectAble Inc. “Services” means the ConnectAble websites, hosted platforms, student and staff dashboards, software features, messaging functions, integrations, support materials, and related services. “School” means the school, adult education program, agency, nonprofit, or other organization that subscribes to or authorizes use of the Services. “Authorized User” means a person whom a School permits to use the Services, including administrators, staff, instructors, contractors, and students. “Student Data” means information about a student that is submitted to, stored in, generated through, or accessed through the Services. “School Data” means Student Data and other data, content, records, files, and communications submitted by or for a School.
2 Eligibility and Acceptance
You may use the Services only if you can form a binding agreement under applicable law and are authorized by the School associated with your account. Students who are not legally able to accept these Terms may use the Services only with authorization from their School and any consent required from a parent or legal guardian.
The Services are designed primarily for adult education. They are not directed to children under 13 for independent use. A School may permit a child under 13 to use the Services only when that use is lawful, educational, supervised by the School, and supported by any notice or consent required by law. The School is responsible for determining whether its student population requires additional consent or protections.
3 Services and Contract Priority
ConnectAble provides configurable tools for adult education programs. Depending on the School’s plan and configuration, the Services may include enrollment and registration, student information and contact management, appointment scheduling, attendance, document and test-score records, learning and career resources, program reporting and integrations, staff resources, role-based access, student dashboards, and text, email, or dashboard messaging. Features may differ by School, state, subscription, and configuration.
A separate membership agreement, order form, statement of work, data protection agreement, business associate agreement, or other written agreement may govern a School’s use of specific Services. If a separate signed agreement directly conflicts with these Terms, the separate signed agreement controls for that conflict.
4 Accounts and Access
- Users must provide accurate information and keep account and contact information current.
- Users must protect passwords, login codes, and devices and must not share credentials or permit unauthorized access.
- Users must promptly notify the School and ConnectAble if they suspect unauthorized use, compromised credentials, or a security incident.
- A School controls user roles and permissions for its account. School administrators may create, modify, suspend, review, or remove Authorized User access.
- ConnectAble may rely on instructions from a School’s authorized administrators concerning accounts, access, School Data, configuration, and support.
A School may allow authorized staff to view the Services from a student’s perspective to provide support and manage student records. Students should understand that their School can access information, files, activity, and communications associated with the School’s platform as permitted by law and School policy.
5 School Responsibilities
Each School is responsible for its administration and use of the Services. This includes:
- authorizing users, assigning appropriate roles, reviewing access, and promptly disabling accounts that should no longer have access;
- giving students, staff, and other individuals all notices and choices required by law or School policy;
- obtaining any consent or other legal authority required to collect, upload, disclose, use, or communicate School Data through the Services;
- maintaining accurate records and reviewing data, calculations, exports, reports, and submissions before relying on or filing them;
- configuring the Services appropriately for the School’s programs, locations, courses, reporting requirements, and access policies;
- complying with laws and policies governing education records, privacy, accessibility, employment, communications, record retention, and public records; and
- ensuring that messages sent through the Services are lawful, appropriate, accurately addressed, and supported by any required consent.
ConnectAble provides tools and technical support, but the School remains responsible for its educational, administrative, reporting, and compliance decisions.
6 Student and User Responsibilities
Authorized Users must use the Services for legitimate educational, administrative, support, or personal account purposes approved by their School. Users must keep submitted information accurate, respect the privacy of others, follow School policies, and promptly correct or report information they know is inaccurate.
Students should direct questions about enrollment decisions, course placement, attendance, test scores, records, accommodations, services, or other School decisions to their School. ConnectAble supplies the technology and ordinarily does not make those decisions.
7 School Data and Student Records
As between ConnectAble and the School, the School and its users retain their rights in School Data. These Terms do not transfer ownership of School Data to ConnectAble. The School determines what School Data is submitted, which users may access it, how long the School needs it, and how the School uses exports and reports, subject to applicable law and any separate agreement.
The School authorizes ConnectAble and its service providers to host, copy, transmit, display, organize, back up, secure, and otherwise process School Data only as reasonably necessary to provide, maintain, secure, support, and improve the Services; comply with the School’s lawful instructions and the parties’ agreements; and meet legal obligations.
To the extent the Family Educational Rights and Privacy Act applies and the parties rely on the school official exception, ConnectAble will use covered education records to perform the contracted institutional service or function, will remain under the School’s direct control regarding the use and maintenance of those records as established by the parties’ agreement, and will not redisclose or use those records except as authorized by the School or permitted by law.
ConnectAble may use aggregated or deidentified information that cannot reasonably identify a student, user, or School to operate, secure, analyze, and improve the Services and to prepare statistical information, subject to applicable law and any separate agreement. ConnectAble will not sell Student Data or use Student Data for targeted advertising.
Requests to access, correct, export, or delete student records should ordinarily be directed to the School because the School controls those records. ConnectAble will reasonably assist the School as required by applicable law and the parties’ agreement.
8 Privacy and Security
Our Privacy Policy explains how ConnectAble collects, uses, and protects personal information in connection with its websites and Services. It is available at https://getconnectable.com/privacy/. A School-specific agreement or notice may provide additional terms for Student Data or other School Data.
ConnectAble maintains administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of information. No security measure or method of transmission is completely secure. ConnectAble will comply with applicable security-incident and breach-notification duties. Additional security commitments, audit reports, incident notification duties, and data-processing terms are governed by any separate written agreement.
9 Communications
The Services may allow a School and its users to send or receive email, text messages, and dashboard messages. Message and data rates may apply to text messages. Delivery is not guaranteed and may be affected by carriers, providers, device settings, network availability, or inaccurate contact information.
A School is responsible for the content, recipients, timing, consent, and legal basis for messages it sends. Users may follow the instructions in a message or contact their School to change communication preferences. Opting out of text messages may not stop email, dashboard, or other communications that the School is permitted or required to send.
The Services are not an emergency notification system. Users should not rely on them to contact emergency services or to deliver urgent medical, safety, or crisis communications.
10 Acceptable Use
You may not use or attempt to use the Services to:
- violate any law, regulation, court order, or the rights of another person;
- access, use, alter, disclose, or delete an account or data without authorization;
- upload malware, harmful code, unlawful content, or material that infringes intellectual property, privacy, or other rights;
- harass, threaten, discriminate against, exploit, impersonate, or defraud another person;
- send spam, unlawful marketing, or messages to recipients without required authorization or consent;
- probe, scan, test, bypass, disable, or interfere with security, authentication, access controls, rate limits, or system integrity;
- reverse engineer, copy, scrape, frame, resell, sublicense, or create a competing service from the Services except to the limited extent a restriction is prohibited by law;
- use automated means to access the Services except through an interface or integration authorized by ConnectAble; or
- use the Services in a way that disrupts them, burdens infrastructure unreasonably, or harms another user.
ConnectAble may investigate suspected violations and may remove content or restrict access when reasonably necessary to protect users, the Services, or third parties; comply with law; or enforce these Terms.
11 ConnectAble Materials and Feedback
The Services, including their software, design, workflows, documentation, logos, text, graphics, and other materials supplied by ConnectAble, are owned by ConnectAble or its licensors and are protected by intellectual property laws. Subject to these Terms and any separate agreement, ConnectAble grants each Authorized User a limited, nonexclusive, nontransferable, revocable right to use the Services during the applicable subscription or authorized access period solely for the purposes approved by the School.
If you provide ideas, suggestions, or feedback about the Services, you grant ConnectAble a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or compensation. This right does not give ConnectAble ownership of School Data or permit ConnectAble to identify a student in public materials without lawful authorization.
12 Third Party Services and Integrations
The Services may connect to or rely on third-party products, telecommunications providers, payment services, learning tools, websites, or state and School systems. Third-party services are governed by their own terms and privacy practices. ConnectAble is not responsible for a third party’s acts, omissions, content, availability, or security, although a separate agreement may state specific integration or support obligations.
13 Professional and Sensitive Information
ConnectAble’s reporting, career, learning, mental health, and resource tools provide technology and information support. They do not replace a School’s professional judgment or constitute legal, medical, mental health, financial, or other professional advice. Mental health tools are not crisis services, diagnosis, treatment, or a substitute for a qualified professional. If a person may be in immediate danger or experiencing an emergency, contact 911 or the appropriate local emergency service.
Reports, calculations, integrations, reminders, and exports may depend on information supplied by the School, users, and third parties. The School must review them for accuracy and suitability before using them for official reporting, eligibility, placement, graduation, funding, compliance, or other consequential decisions. ConnectAble does not guarantee enrollment, completion, certification, employment, funding, or any educational or career outcome.
14 Fees Support and Service Changes
School fees, payment terms, subscription periods, renewal, implementation, support, customization, and service levels are governed by the applicable membership agreement, order form, or statement of work. Unless a separate agreement states otherwise, ConnectAble may update, add, limit, or discontinue Service features to improve performance, security, usability, or legal compliance. ConnectAble will use reasonable efforts to avoid materially reducing paid core functionality during an active subscription.
The Services may be unavailable during maintenance, upgrades, emergencies, third-party outages, security events, or circumstances beyond ConnectAble’s reasonable control. ConnectAble does not promise uninterrupted or error-free operation.
15 Suspension and Termination
A School or user may stop using the Services at any time, subject to the School’s separate agreement. ConnectAble may suspend or terminate access if a user or School materially violates these Terms or a separate agreement; creates a security, legal, or operational risk; fails to pay undisputed amounts when due; or if suspension is reasonably necessary to protect the Services or another person. When practical, ConnectAble will provide notice and an opportunity to cure before suspending paid School access.
When a School’s service ends, access to School Data, export rights, retention, return, and deletion are governed by the School’s agreement, ConnectAble’s retention schedule, and applicable law. Students should contact their School about records after their access ends. Sections that by their nature should survive termination remain in effect, including provisions concerning intellectual property, confidentiality, disclaimers, liability, indemnification, and dispute terms.
16 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND EXCEPT FOR WARRANTIES EXPRESSLY STATED IN A SEPARATE SIGNED AGREEMENT, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CONNECTABLE DISCLAIMS ALL IMPLIED OR STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. CONNECTABLE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR SUITABLE FOR EVERY SCHOOL’S LEGAL OR REPORTING REQUIREMENTS.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply.
17 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONNECTABLE AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY; OR LOSS, CORRUPTION, OR UNAVAILABILITY OF DATA, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
EXCEPT FOR LIABILITY THAT CANNOT LAWFULLY BE LIMITED AND EXCEPT AS A SEPARATE SIGNED AGREEMENT PROVIDES, CONNECTABLE’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNTS THE SCHOOL PAID CONNECTABLE FOR THE AFFECTED SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. FOR A CLAIM BY A USER WHO USES ONLY FREE OR PUBLIC SERVICES AND IS NOT COVERED BY A SCHOOL’S PAID AGREEMENT, CONNECTABLE’S TOTAL LIABILITY WILL NOT EXCEED $100.
The limitations in this section apply regardless of the form of action and only to the extent permitted by law. Some jurisdictions do not allow certain liability limitations, so some of these limitations may not apply.
18 Indemnification
To the extent permitted by law, each School will defend, indemnify, and hold harmless ConnectAble and its directors, officers, employees, volunteers, and contractors from third-party claims, damages, judgments, penalties, and reasonable costs arising from the School’s or its Authorized Users’ unlawful use of the Services; School Data that infringes another person’s rights; messages sent without required consent; or the School’s material breach of these Terms. This obligation does not apply to the extent a claim results from ConnectAble’s breach of a separate agreement, negligence, willful misconduct, or violation of law. A School’s indemnification obligations may be limited by applicable law or a separate signed agreement.
19 Changes to These Terms
ConnectAble may update these Terms to reflect changes in the Services, law, security practices, or business operations. ConnectAble will post the updated Terms and revise the effective date. If a change materially affects a School’s rights or obligations, ConnectAble will provide additional notice when required by law or the School’s agreement. Continued use after the updated Terms take effect constitutes acceptance, except where law or a separate agreement requires another form of consent.
20 Governing Law and Disputes
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules, except to the extent federal law applies or applicable law requires another result. Unless a separate signed agreement states otherwise, the state courts located in Vermilion County, Illinois, and the federal courts in the Central District of Illinois will have exclusive jurisdiction over disputes arising from these Terms or the Services, and each party consents to those courts’ personal jurisdiction. Before filing a claim, the parties will attempt in good faith to resolve the dispute informally.
21 General Terms
These Terms and any applicable separate agreement form the complete agreement about their subject matter and replace prior or contemporaneous understandings about that subject matter. A failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be modified only as much as necessary, and the remaining provisions will remain effective. Headings are for convenience only.
Users may not assign these Terms without ConnectAble’s written consent. ConnectAble may assign them in connection with a merger, reorganization, sale of assets, or transfer to an affiliate or successor, provided the assignee remains responsible for the applicable obligations. Neither party is liable for delay caused by events beyond its reasonable control, except that this sentence does not excuse payment obligations.
